General Terms & Conditions
Preamble :
These General Terms and Conditions (hereinafter "GTC") are concluded exclusively between (1) the company Nouvelle UJA, a simplified joint stock company with a capital of 2,000,000 euros registered in the Bobigny Trade Register under number 889 120 580 whose head office is located at 100 avenue du Général Leclerc in Pantin (93500) holder of the UN JOUR AILLEURS brand and (2) any person making a purchase on the site www.unjourailleurs.com (hereinafter referred to as the “Customer” ).
The Customer hereby declares formally acknowledges that they are an individual, natural person, non-professional or merchant, that they are of legal age or hold parental authorisation and that they have full and entire legal capacity to contract and to place an order online on the site www.unjourailleurs.com
The Customer and the company Nouvelle UJA agree together that their relations are governed exclusively by these General Terms and Conditions.
In this regard, the Customer acknowledges that any order validated by "double click" within the framework of the remote ordering procedure implies irrevocable acceptance of these General Conditions of Sale. This validation of the Customer associated with the authentication and non-repudiation procedure and the protection of the integrity of the messages constitutes a manifestation of the unequivocal will of the Parties thus deemed to be signatories of the distance selling act.
Un Jour Ailleurs reserves the right to adapt or modify these General Conditions of Sale at any time. Each order will be deemed to have been subscribed according to the terms of use and apply the GTC in force on the day it is placed on the site www.unjourailleurs.com, the date of posting of the GTC being the date of entry into force.
The GTC of Un Jour Ailleurs from this site are available in both French and English.

- Article 1 – Confirmation of the order on the website :
To place an order on the site www.unjourailleurs.com, the Customer will be guided through the following steps:
- Selection of products on the site in the "Basket",
- Choice, when offered, of the delivery method of the products displayed in the "basket",
- A modifiable summary of the order, and the total price,
- Choice of payment method,
- Sending of an order validation email to the Customer confirming their order after payment has been accepted. The order validation email sent to the Customer confirms the acceptance by Nouvelle UJA of the Customer's order, and confirms the formation of the sales contract between the Parties.
- Article 2 - Validity of offers - Product availability:
The products displayed on the site www.unjourailleurs.com at a given moment are in principle deemed to be available in stock at that same moment, except for time-limited offers that are part of a particular operation expressly mentioned as such on the product page. .
This a priori availability is checked after the order has been accepted for payment and is confirmed by sending the dispatch email by Un Jour Ailleurs.
In the event of unavailability of one or more products, Un Jour Ailleurs undertakes either to offer the Customer a new delivery date for the product (s) ordered or to reimburse them by crediting the means of payment used during the purchase. This will be processed within 14 calendar days of payments being made. If a technical event prevents the re-accreditation of the payment method used, Un Jour Ailleurs will offer the Client the re-accreditation of any other bank card in the Client's name, at their written request.
The product and special offers are deemed to be those displayed during the checkout represented by the "BASKET" page of the website www.unjourailleurs.com. Thus, only the price indicated on this page, corresponding to that charged to the Customer when ordering, authenticates and commits Un Jour Ailleurs from a contractual point of view. Therefore, any typographical error on any other page likely to occur on graphic and / or promotional elements within the site, cannot engage the responsibility of Un Jour Ailleurs.
- Article 3 - Price :
The prices displayed on the site www.unjourailleurs.com are expressed in euros (€) and are understood to be public prices, all charges included, as they may be applicable in mainland France on the date that said offers are viewed. The amount of VAT applied is that in force on the date the order is placed. Specific taxes, other than VAT, may be applicable according to regulations (such as for example the furniture ecotax or the participation eco tax). These taxes are only indicated on the basket page, the only page to be valid as indicated as noted in the last paragraph of article 2 above.
All product prices displayed on the site www.unjourailleurs.com exclude postage or any other ancillary services. Prices include only the price of the product itself as described, as well as its packaging.
Un Jour Ailleurs reserves the right to modify its prices at any time but undertakes to apply the prices displayed when the order is placed, subject to availability on that date.
All products remain the property of Un Jour Ailleurs until full receipt of the price by the latter.
- Article 4 - Payment :
4.1 TERMS OF PAYMENT
Whatever the method of payment chosen among those accepted on our site, orders will only be deemed to have been recorded after validation or receipt of payment.
Thus, as long as the payment is not validated by the intermediary chosen by the consumer, the order cannot be prepared for delivery by the Un Jour Ailleurs brand.
4.1.1 Cash payment by credit card
Payment can be made by the following bank cards: Carte Bleue, VISA, MASTERCARD and MAESTRO.
The Customer is able to consult the General Conditions of Sale and use of each of these bank cards on the sites of our partners.
The choice of one of these payment cards implies tacit acceptance of the general conditions of sale and use of said partners.
The company Nouvelle UJA cannot be held responsible for the conditions set by these independent partners, and we invite our customers to refer to those conditions.
Online payment by credit card is perfectly secure and allows you to enter with confidence card numbers, expiration dates and security codes in the slots provided for this purpose. Credit card details are encrypted using SSL (Secure Socket Layer) and never pass unencrypted over the network. Payment is made directly to the bank. Un Jour Ailleurs has no access to these details and cannot keep them on its servers. This is the reason why details are requested again with each new transaction on our site.
4.1.2 Cash payment by Paypal
Paypal payments are accepted on the site www.unjourailleurs.com and are then made through the partner in question and according to its own general conditions of sale and use of its services.
The choice of this payment implies tacit acceptance of the general conditions of sale and use of the Partner.
Un Jour Ailleurs cannot be held responsible for the conditions set by these independent partners and we invite customers to consult those conditions of sale.

4.2 FIGHT AGAINST FRAUD
Un Jour Ailleurs reserves the right to check the validity of any payment before shipping the order, by any means it deems necessary (in particular identity documents, proof of address, etc.).
4.3 PAYMENT DISPUTE
Un Jour Ailleurs reserves the right to refuse to make a delivery or to honour an order from a Customer who has not fully or partially paid a previous order or with whom a payment dispute is being administered. . In the event of fraud, Un Jour Ailleurs reserves the right to remove any member without notice or compensation.
- Article 5 - Delivery :
5.1 ORDER PREPARATION TIMES
Un Jour Ailleurs reserves the right to subcontract all or part of the preparation and shipment of the order to a third party appointed for the performance of this service.
Since all products sold by Un Jour Ailleurs are deemed to be available in stock, orders are prepared within 6 to 10 working days from the first working day following the registration of the order within the meaning of these T & Cs. Thus, orders registered on a Saturday, Sunday or public holiday will be processed on the next working day.
All of the deadlines mentioned on the site www.unjourailleurs.com are understood to be clear deadlines.
The ordered product will be delivered to the address appearing on the order form and recorded as the "delivery" address.
In the event of an entry error, in particular an incorrect or incomplete delivery address, Un Jour Ailleurs cannot be held responsible for the consequences in terms of delay or impossibility of delivery. All costs related to the reshipment of products following an entry error by the Customer will be the sole responsibility of the latter.
5.2 DELIVERY TIMES OF ORDERS
Un Jour Ailleurs reserves the right to choose the most suitable mode of transport depending on the nature of the product, its weight and its volume. The Customer declares to have read and accepted this information.
Delivery times may not exceed 30 working days after the date of validation of payment by the Customer (date of registration of the order). Delivery times cannot be guaranteed in the event of force majeure, as defined by law and case law.
Delivery times do not take into account any Customer payment control procedures that would delay the shipment of their order (see provisions of article 4.2).
The announced deadlines commence from the registration of the order. The expected delivery date is indicated when ordering and on each of our product pages. This time is an average time corresponding to the service used for delivery in mainland France. In the event of missed deliveries, the Customer will be responsible for recovering the product from the services concerned.
5.3 DELIVERY TRACKING
The Customer can track their order at any time using the order number communicated in the email formally registering their order, in the "My Account" area on the site www.unjourailleurs.com.
This space allows a precise follow-up for each mode of transport, providing information regarding the order and its status, relating in particular to the expedition or its delivery.
It is recalled that all communication between the Customer and the site www.unjourailleurs.com being mainly carried out through email exchanges, it is essential that the Customer provides a valid and regularly updated email address. . Otherwise, Un Jour Ailleurs cannot be held responsible for the consequences resulting from the communication of an incorrect or not updated email address.
5.4 DELIVERY ZONES
Delivery takes place in Metropolitan France, Belgium and Luxembourg.
5.5 SPECIAL DELIVERY TIMES
The delivery methods for Un Jour Ailleurs products are established by the company itself and depend on their admission to postal volume.
When a product is admitted in postal volume, the Customer will have the freedom to choose between delivery to their home via Colissimo or collection of the order in store. This will be selected at the time of validation of the basket on the website www.unjourailleurs. com
After validation of these transport methods and before payment for the order, the site www.unjourailleurs.com will display a summary of the order by mode of transport, to which the products in question are eligible and according to the option chosen by the Customer when it has been offered to them. The cost of the transport methods affected or chosen will then be displayed before payment of the order.
When the order has been duly prepared and is ready for shipment, the Customer will receive an email relating to the dispatch of each part of their order by means of transport thus agreed.
⇒ Delivery by Colissimo: Delivery by Colissimo is a service offered by La Poste, and meets its own General Conditions of Use. Should they be absent at the time of delivery and staff cannot drop off the package with a guardian, the Customer will receive a calling card. They will then have 14 calendar days to collect their package from the post office indicated on the said notice. Failing this, the order will be sent back to Un Jour Ailleurs who will follow up with the Customer by email to send them their order at their own expense. If there is no response from the Customer within 7 days of sending this reminder email, Un Jour Ailleurs will consider that the Customer has exercised their right of return and will proceed to the refund under the conditions provided for the exercise of the right of withdrawal (see article 6-1 of these GTC).
5.6 TARIFS DE LIVRAISON
Delivery prices are calculated according to a rule taking into account the destination on one hand and the weight of the package on the other. The prices indicated are all in euros (€) and all taxes and charges are included, including VAT at the rate in force on the day of delivery.
The cost is automatically calculated as soon as a product is added to the basket on the basis of delivery in mainland France. The Customer can freely consult the invoicing policies of the carrier associated with their products.
The final calculation of the shipping costs for other destinations is made once the postal code has been entered on the delivery address and before the Customer confirms their order.
Specific free shipping offers are only valid within the framework of a shipment to mainland France, unless expressly stipulated otherwise.
- Article 6 - Right of Withdrawal :
6.1. CONDITIONS OF EXERCISING THE RIGHT OF WITHDRAWAL
Time limit
In accordance with the provisions of article L. 121-21 of the Consumer Code, the Customer has 14 calendar days to exercise their right of withdrawal, without needing to provide any justification. The period begins the day after the day of receipt of the order. In the case of an order for several goods delivered separately or in the case of an order for a product made up of lots or multiple parts whose delivery is spread over a defined period, the period starts from receipt of the last good or lot. For contracts providing for the regular delivery of goods during a defined period, the period starts from the receipt of the first good.
Exercise of the right of withdrawal
To exercise their right of withdrawal, the Customer must inform Un Jour Ailleurs of their decision by sending the company, before the expiry of the aforementioned 14-day period, the standard withdrawal form provided for this purpose. This will have been sent to them with the email confirming the order (and reproduced in the appendix to these T & Cs). Any other unambiguous declaration expressing their desire to withdraw can also be supplied.
Loss of the right of withdrawal
Pursuant to Article L 121-21-8 of the Consumer Code, it is recalled that the right of withdrawal cannot be used for contracts:
1 ° The provision of services fully executed before the end of the withdrawal period and whose execution has begun after the express prior consent of the consumer and express waiver of his right of withdrawal;
2 ° The supply of goods or services, the price of which depends on fluctuations on the financial market beyond the control of the professional and likely to occur during the withdrawal period;
3 ° The supply of goods that have been made to the consumer's specifications or have been clearly personalised;
4 ° The supply of goods that are liable to deteriorate or expire rapidly;
5 ° The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
6 ° The supply of goods which, after having been delivered and by their nature, are inseparably mixed with other items;
7 ° The supply of alcoholic beverages the delivery of which is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on fluctuations on the market beyond the control of the professional;
8 ° Maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by him, within the limit of spare parts and work strictly necessary to respond to the emergency;
9 ° The supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery;
10 ° Supply of a newspaper, periodical or magazine, except for subscription contracts to these publications;
11 ° Concluded at a public auction;
12 ° Provision of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities which must be provided on a specific date or period;
13 ° The supply of digital content not supplied on a physical medium, the execution of which has begun after the express prior consent of the consumer and express waiver of their right of withdrawal.
Conditions relating to the condition of the product
To exercise this right of withdrawal, the returned product must be returned in a condition allowing its immediate resale. The product must therefore be returned in “as new” condition, complete with any manuals and various accessories with which it was delivered and in its original packaging. Nouvelle UJA reserves the right to refuse reimbursement of the product if all of these conditions are not met.
Terms of reimbursement. In the event of exercise of the right of withdrawal within the aforementioned period, and in accordance with the provisions of Article L121-21-4 of the Consumer Code, Un Jour Ailleurs will reimburse the Customer for the price of the product (s) returned in this way. Reimbursements for the product (s) in question will be made within 14 calendar days from the date on which it was informed of the Customer's decision to withdraw.
The customer must return the Product (s), at the latest, within 14 days of the communication of their decision to withdraw. Returns can be made: - free of charge in one of our UJA stores within 14 days of receiving your order. Un Jour Ailleurs nevertheless reserves the right to defer reimbursement until recovery of the goods or until the Customer has provided proof of shipment of these goods, the date chosen being that of the first of these two facts.
Reimbursement will always be made on the basis of the sums actually paid by the Customer, as entered on their invoice. However, Un Jour Ailleurs reserves the right to refuse to reimburse the additional delivery costs generated by a more expensive delivery method expressly chosen by the Customer when Un Jour Ailleurs had offered him a standard delivery method such as the Enfin service. In principle and unless otherwise expressly requested by the Customer, Un Jour Ailleurs will reimburse the latter by crediting the means of payment used during the purchase. In the event that it is materially impossible to use this process, Un Jour Ailleurs will offer the Customer to issue a bank check payable to them for the amount due and to send it to them by post.
Return shipping charges
Return costs are expressly the responsibility of the Customer, who recognises and accepts this by adhering to these General Terms and Conditions.
- Article 7 - Complaints about orders:
If during the unpacking of products and within 15 calendar days from receipt of these products, the Customer discovers that a product does not comply with their order or the product sheet (example: error on the product, the model, colour, other) Un Jour Ailleurs then undertakes to replace it or to reimburse the Customer for all of their costs as soon as the defect is noted and confirmed. To do this, the Customer must contact Customer Service to make their complaint and follow the given procedure. After receipt of the duly returned product and observation of the non-conformity or damage reported by the Customer, Un Jour Ailleurs may at its sole discretion,
- Either send a new product to the Customer, at no additional cost,
- Or refund the sums paid during the purchase of this product. Any other potential defect during the "life" of the product will be assessed in the context of recourse to after-sales service.
- Article 8 - After-sales service:
Apart from the commercial or legal warranty, the Customer always has the possibility of contacting Un Jour Ailleurs Customer Service to answer questions relating to the use of a product, maintenance procedures or ordering a component that has become defective.
- Article 9 - Intellectual property:
All elements of the site www.unjourailleurs.com whether visual or sound, including the brand, logo, texts, photos, videos and domain name, are protected by copyright, trademark or patent law. Un Jour Ailleurs, publisher of the site, is the owner or holder of exclusive license and exploitation contracts for intellectual property rights granted by their owner relating to brands, distinctive signs and protected works.
As such, and in accordance with the provisions of the Intellectual Property Code, only private use is authorised, subject to different, or even more restrictive, provisions of the Intellectual Property Code. Any total or partial reproduction of the site www.unjourailleurs.com or of any of its audio, visual or text content is strictly prohibited without express prior written consent.
- Article 10 - Liability:
For all stages of access to the site, the ordering process, delivery, Customer Service or subsequent services, Un Jour Ailleurs only bears an obligation of means. Consequently, Nouvelle UJA cannot be held liable for any inconvenience or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion, or the presence of computer viruses, or any qualified incidence of force majeure, in accordance with article 1218 of the Civil Code and case law. In addition, Un Jour Ailleurs cannot be held responsible in the event that the order does not succeed or if it is prevented from complying with any of its obligations owing to a case of force majeure as defined by article 1218 of the Civil Code and by within the meaning of case law, and in particular in the event of inclement weather preventing the delivery of the order. The liability of Un Jour Ailleurs will not be subject to any exclusion or limitation in the event of death or bodily injury caused by its negligence, in the event of fraud or fraud or in all cases where it would be illegal or contrary to the law to exclude, limit, or attempt to exclude or limit its liability. In accordance with articles L. 217-4 and following of the Consumer Code and articles 1641 and following of the Civil Code concerning hidden defects, Un Jour Ailleurs guarantees consumers against lack of conformity and hidden defects of the products it sells on its website. The Customer thus has the option of returning defective or non-compliant products that are delivered. It is recalled that the consumers who decide to act benefit from the following legal guarantees against non-conforming goods: - A period of two years from the delivery of the goods to act; - A choice between repair and replacement of the goods, subject to the conditions related to cost, provided for in article L 217-9 of the Consumer Code; - Exemption from providing proof of the existence of the lack of conformity of the good during the twenty-four months following the delivery of the good. The legal guarantee of conformity applies independently of any commercial guarantee granted. The consumer may decide to invoke the guarantee against hidden defects of the item sold within the meaning of article 1641 of the Civil Code. In this case, the consumer can choose between the cancellation of the sale and a reduction of the sale price, in accordance with article 1644 of the Civil Code.
Reminder of the provisions of the Consumer Code:
- Article L 217-4 of the Consumer Code
The good complies with the contract if it meets the following criteria, where applicable:
1 ° It corresponds to the description, type, quantity and quality, in particular with regard to functionality, compatibility, interoperability, or any other characteristic provided for in the contract;
2 ° It is suitable for any special use sought by the consumer, brought to the attention of the seller at the latest at the time of the conclusion of the contract and which the latter has accepted;
3 ° It is delivered with all accessories and installation instructions, to be supplied in accordance with the contract;
4 ° It is updated in accordance with the contract.
- Article L 217-5 of the Consumer Code
I.- In addition to the criteria for compliance with the contract, the good is compliant if it meets the following criteria:
1 ° It is proper to the use usually expected of a product of the same type, taking into account, if applicable, any provision of European Union and national law as well as all technical standards or, in the absence of such technical standards, specific codes of conduct applicable to the sector concerned;
2 ° Where applicable, it has the qualities that the seller presented to the consumer in the form of a sample or model, before the conclusion of the contract;
3 ° Where applicable, the digital elements it contains are provided according to the most recent version available at the time of the conclusion of the contract, unless the parties agree otherwise;
4 ° Where applicable, it is delivered with all accessories, including packaging, and installation instructions that the consumer can legitimately expect;
5 ° Where applicable, it is provided with the updates that the consumer can legitimately expect, in accordance with the provisions of article L. 217-19;
6 ° It corresponds to the quantity, quality and other characteristics, including in terms of durability, functionality, compatibility and safety, that the consumer can legitimately expect for goods of the same type, having regard to the nature of the good as well as to public statements made by the seller, by any person upstream in the chain of transactions, or by a person acting on their behalf, including in advertising or on the product labelling.
II.-However, the seller is not bound by any public declarations mentioned in the preceding paragraph if they demonstrate:
1 ° That they did not know them and was legitimately not in a position to know them;
2 ° That at the time of the conclusion of the contract, the public declarations had been rectified under conditions comparable to the initial declarations;
or 3 ° That public statements could not have had any influence on the purchase decision.
III.-The consumer cannot contest the conformity by invoking a defect concerning one or more particular characteristics of the good, of which he has been specifically informed that they deviate from the conformity criteria set out in this article, a deviation to which he has expressly and separately agreed upon conclusion of the contract.
Reminder of the provisions of the Civil Code:
Article 1641 of the Civil Code
The seller is bound by the warranty for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it, or would have acquired it at a lower price, if they had known them.
Article 1648 paragraph 1 of the Civil Code
The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.
Article 11 - Completeness:
These General Conditions of Sale and any other document mentioned in these Conditions constitute the entire Contract concluded between the parties and replace any agreement previously concluded orally or in writing between the parties. In the event that one of the clauses of this contract is declared null and void by a change in legislation, regulation, or by a court decision or by virtue of an irrevocable decision from a competent authority, this can in no way affect the validity and compliance with all the other provisions of these General Terms and Conditions.
Article 12 - Proof:
The computerised registers, kept in the computer systems of Un Jour Ailleurs and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the Parties.
Article 13 - Storage and archiving of transactions:
The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1348 of the Civil Code.
Article 14 - Disputes:
These General Terms and Conditions of Sale are subject to French law. If the Customer considers that their rights have been violated, they can send their complaint by means of the contact form found in the "My account" area or by email to the following address: serviceclient@www.unjourailleurs.com . The Customer may, after having addressed a written complaint to Un Jour Ailleurs as mentioned above and if the Parties have not reached a satisfactory solution, resort to the mediation service of the National Association of Mediators (ANM), via email: contact@anm-conso.com or by post: 62 rue Tiquetonne, 75002 PARIS, France. Under European regulation n ° 524/2013, the Customer has the right to request the resolution of the dispute on the platform dedicated to the online resolution of consumer disputes which is accessible at the following email address: https: // ec. europa.eu/consumers/odr/main/?event=main.home.selfTest.
The Client may refer the matter to the mediator within a maximum period of one year from the date of the written complaint to Un Jour Ailleurs. In the event of recourse to amicable settlement and its failure, only the French courts will be competent.

Article 16 - IT provisions and freedoms:
Un Jour Ailleurs processes all personal data in accordance with the provisions of Law No. 78-17 of January 6, 1978 known as the "Data Protection Act" as amended by Law No. 2018-493 of 20 June 2018, by ordinance n ° 2018-1125 of 12 December 2018 as well as by EU Regulation 2016/679 relating to the protection of personal data.
